Appeal Alleges Linden Municipal Judge DiLeo Denied Defendant Due Process

"If true, that would be an extraordinary denial of due process for the defendants and a series allegation of judicial misconduct for the judge."

The New Jersey Law Journal reports that Prosecutor Nicholas Scutari has no recollection of how the case was scheduled without his knowledge.

Nick missed it? Oh, he was probably doing some research into his medical marijuana bill at the time...

no surprise, this is the same prosecutor during a case where a resident threatened 2 other residents by yelling into the house to "get the gun, get the gun", then failed to interview one victim instead choosing to interview a linden cop who was a friend of the defendant and prosecutor but was no where on the scene. Bottom line he is simply a weasel.

This could be really bad for Linden as I would imagine that a lot of cases he has presided over in the past will now be reviewed for similar violations of due process and lawsuits against the City by those who's rights were violated will be filed.

The State agrees that the defendant's rights were violated according to an article on NJ.Com this morning.

Nick is an fair, honest and intelligent attorney. I have had the opportunity to work with him and he honestly cares about the people of New Jersey. We should be thankful that someone like him has those positions. Everyone on here with a negative comment towards him should stop being a hater and get a life.
